    New York Family Leave Update

    Over the past two weeks, New York State sent letters to New York employers informing them about the new family leave program. As discussed in the post on June 29, 2017, employers were permitted, but are not required, to begin withholding from employee compensation starting on July 1, 2017, to cover the cost of this new program.  Over the next several weeks, employers should expect to receive notification from their disability policy carriers about the cost and other logistics related to the new program.

    The family leave program will be added to the disability policies that employers are already required to maintain for employees. The websites of most disability carriers already offer sample printed notices to be used to inform employees about the program, as well as other useful information about managing employee family leave.

    Businesses need to plan both for the administration of the program and for the staffing needs that may arise if/when an eligible employee is absent due to family leave. While such absences cannot occur before 2018, now is a good time for employers to begin considering staffing alternatives to cover the assignments and tasks that an eligible employee usually handles, if he or she were to be absent from work due to the family leave program.
